In course of investigation, one Puja Kumari who happens to be minor daughter of the informant, claims herself to be eye witness of the alleged occurrence and specifically, stated that it was the petitioner who committed murder of the deceased who was none else but the father of the petitioner. Considering the aforesaid facts and circumstances as well as submission of the parties, I am not inclined to release the petitioner on bail and accordingly, prayer for bail of the petitioner in connection with Korha P.S. Case No. 115 of 2014 pending in the court of Chief Judicial Magistrate, Katihar stands rejected. However, learned Chief Judicial Magistrate,

Patna High Court Cr.Misc. No.51124 of 2014 (5) dt.02-04-2015 2/2 Katihar is directed to commit the case of the petitioner to the Court of Sessions within four weeks from the date of receipt/production of copy of the order in accordance with law and after that, the Sessions Court shall try to conclude the trial of the petitioner as early as possible.
