JUSTICE GOPAL PRASAD ORAL ORDER 11-02-2016 Heard learned counsel for the petitioner and learned counsel for the State.

This is a petition for grant of regular bail in a case under Sections 304(B) and 120(B) of the Indian Penal Code. It is alleged that the petitioner has got love marriage with the victim for which the parents of the petitioner annoyed and demanded Rs.4,00,000/- as dowry and due to non-fulfillment of the said demand, the parents of the petitioner driven them out and thereafter the petitioner along with victim went to live outside the house at some distance in a thatched house. It is further alleged that the petitioner used to subject the victim to cruelty for demand of dowry and also threatened her to do away her life. It is further alleged that when the deceased could not fulfill the demand of

Patna High Court Cr.Misc. No.50156 of 2015 (3) dt.11-02-2016 dowry, the accused persons committed murder of the deceased under a conspiracy by pressing her neck. The cause of death is due to asphyxia.

It is submitted that except suspicion, there is nothing against the petitioner.

Hence, having regard to the facts and circumstances of the case and the nature of the allegation and the main allegation is against the family members of the petitioner, the petitioner above named is ordered to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Araria, in connection with Palasi P.S. Case No. 40 of 2015 corresponding to G.R. No. 654/2015. (Gopal Prasad, J.) Amit/- U T
