2. The petitioner seeks bail in connection with Sessions Trial No. 1084 of 2025 arising out of Maner P.S. Case No. 831 of 2024 registered for the offence under Sections 103(2), 3(5), 61(2) of the BNS, 2023.

3. As per the prosecution case, the petitioner is the husband and he is alleged to have killed his wife along with one Aklu Devi, who was in relationship with the petitioner.

4. The petitioner is in custody since 2.12.2024.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

She further submits that deceased has consumed Celphos and because of the same she died and the same is also apparent from the FSL report. She next submits that the trial is being delayed and out of six witnesses only one has been examined. She also submits that there is no external injury on the body of the deceased.

6. Learned APP for the State has opposed the application of the petitioner.

7. From the materials available on record and the FSL report, it appears that the deceased may have committed suicide.

8. Considering the period of custody of the petitioner and the delay in trial, this application is allowed.

9. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court below in connection with Sessions Trial No. 1084 of 2025 arising out of Maner P.S. Case No. 831 of 2024.

10. As a condition of this order, the petitioner, after being released on bail, is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court

Patna High Court CR. MISC. No.8683 of 2026(6) dt.12-05-2026 3/3 on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.

It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not expressed any opinion on the merits of the case.
