JUSTICE RAVI RANJAN ORAL ORDER 14-12-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offence punishable under Sections 395 and 397 of the Indian Penal Code. It is contended on behalf of the petitioner that he is neither named in the FIR nor has any incriminating substance been recovered from his possession. The petitioner was remanded in this case on 28.09.2015 from Bihar P.S.Case No.175/2015 and since then he is in jail custody but up to now, he has not been put on Test Identification Parade. It is further contended that two other co-accused, namely, Mannu @ Mantu Kumar and Subodh Ravidas @ Subodh Kumar have already been granted bail vide Cr. Misc. Nos.36337/2015 and 38045/2015 respectively.

Having regard to the aforementioned facts and

No.52415 of 2015 (2) dt.14-12-2015 2/2 circumstances, the petitioner, namely, Samdarshi Rai @ Samdarshi Yadav @ Tutu Yadav @ Tutu is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheikhpura in connection with Barbigha P.S. Case No.93 of 2015, with a further condition that one of the bailors must be a close relative or family member of the petitioner who shall file affidavit before the concerned court giving complete genealogy to show his/her relationship with him.

If the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds. (Dr. Ravi Ranjan, J) V.K. Pandey/- U T
