JUSTICE RAKESH KUMAR ORAL ORDER 07-12-2015 Heard Sri Neeraj Kumar, learned counsel for the petitioner and Sri M.K.Gautam, learned Addl. Public Prosecutor. The petitioner, who is in custody since 29.04.2015 in connection with Kotwa P.S. Case no.256/2014 registered for the offence under Sections 341, 109, 302/34 of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that on perusal of the F.I.R., it is evident that there was land dispute in between the parties and the petitioner has falsely been implicated in the present case. He further submits that some of the accused have already been granted bail.

Learned Addl. Public Prosecutor has opposed the prayer for bail. He submits that from the order impugned, it is

Patna High Court Cr.Misc. No.52518 of 2015 (2) dt.07-12-2015 2/2 evident that the petitioner is main assailant, against whom there is allegation that he fired on the father of the informant. Keeping in view the fact that the petitioner is main assailant, I am not inclined to extend the privilege of bail. The petition stands dismissed.
