Petitioner apprehend his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 169 litre of illicit foreign liquor from the house of petitioner.

It has been submitted on behalf of the petitioner that petitioner was not present in the house. Nothing has been recovered from the possession of the petitioner. It has been further submitted that the wife of petitioner was taken into custody for the same occurrence and was granted regular bail by a co-ordinate bench of this Court vide order dated 03.02.2020 passed in Criminal Miscellaneous No. 5849 of 2020, as such for

Patna High Court CR. MISC. No.7834 of 2020(2) dt.29-02-2020 2/2 same seizure and offence petitioner cannot be implicated. Petitioner has got no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on anticipatory bail in the event of his/her arrest or surrender before the court below within a period of four weeks from today upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with C-III-331 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
