2. No one appears on behalf of the petitioner though learned AC to GP-8 is present.
3. The present petition has been preferred for the grant of following relief(s):
(i) For issuance of an appropriate Writ/Writs,
Patna High Court CWJC No.19293 of 2017(2) dt.24-06-2025 2/3 direction/directions in the nature Mandamus of for direction upon the Respondents to payment ensure of compensation by making determination in terms of provisions of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 against the land acquired for construction and extension of Dhana Parev Channel within the district of Patna on account of the fact that intimation with respect to the Award and Compensation was made available through the purported notice under section 12(2) of the Land Acquisition Act, 1894 issued under the signature of competent authority made on 28.01.2014, after commencement of the New Land Acquisition Act, 2013 having come into effect from 01.01.2014.
(ii) For any other relief/reliefs which the Hon'ble Court may grant in general interest checking these kinds of harassment to the petitioners by the Government Officials that may be deemed appropriate and necessary in this case for
Patna High Court CWJC No.19293 of 2017(2) dt.24-06-2025 3/3 protecting the interest and rights of the petitioners by ensuring the benefits flowing from the Act.
4. Learned State counsel has taken this Court to the counter affidavit of the respondent no.5 to show that pursuant to the proposed acquisition, the award was prepared and the same was revisited in the year 20018 which followed payments to the awardees including the petitioners.
5. The counter affidavit was filed in the year 2018 after service of copy to the petitioner and there is no rebuttal/reply to the said counter affidavit.
6. This Court is convinced that no case is made out.
7. However, since there is no appearance, the writ petition stands dismissed for non-prosecution. (Rajiv Roy, J) vinayak/- U
