JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2020 The petitioner seeks regular bail in connection with Barauli P.S. Case No. 95 of 2019 (G.R. No. 726 of 2019), registered for offences punishable under Sections 304(B) and 201/34 of the Indian Penal Code.
Allegation against the petitioner is that he along with other co-accused persons has committed the murder of the daughter of Informant.
Submission of learned counsel for the petitioner is that petitioner happens to be the maternal father-in-law of the deceased and there is no specific allegation attributed against him. Further submission is that the sister-in-law of the deceased has been granted anticipatory bail vide order dated 15.10.2019 passed in Cr. Misc. No. 57736 of 2019 by this Court and petitioner has been in judicial custody since 11.10.2019 and
Patna High Court CR. MISC. No.8835 of 2020(2) dt.28-02-2020 2/2 charge-sheet has been submitted, therefore, there is no chance of tampering with the evidence.
Heard learned A.P.P. who has opposed the prayer for bail.
Having heard both sides, in view of the above submissions, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-XIV, Gopalganj in connection with Barauli P.S. Case No. 726 of 2019 (G.R. No. 726 of 2019).
