The petitioners are languishing in custody since 16.07.2014 in a case registered for the offences punishable under Sections 147, 148, 332, 333, 353 and 120B of the Indian Penal Code.
It is alleged that police raided the house of petitioner no. 1 during investigation of Motihari Muffasil P.S. Case No. 400 of 2013 then the villagers attacked the investigating agency, thereafter four persons were apprehended. It is submitted by learned counsel for the petitioners that the accusation is omnibus and general and in
Patna High Court Cr.Misc. No.51730 of 2014 (02) dt.06-01-2015 2/2 Motihari Muffasil P.S. Case No. 400 of 2013 petitioner no. 1 is accused but the petitioners side lodged a case against the informant being Motihari Muffasil P.S. Case No. 15 of 2014 and other accused persons have been granted bail vide Cr. Misc. Nos. 42561 of 2014 and 45856 of 2014.
Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Sadar Motihari, East Champaran in connection with Motihari Muffasil P.S. Case No. 190 of 2014.
Since the petitioners have criminal antecedent, the learned court below will be at liberty to cancel the bail bonds of the petitioners, if they substantially get involved in some serious nature of the offence or default for two consecutive occasions.
