The petitioners, namely, Surendra Mallah @ Surendra Prasad Mallah and Gupteshwar Singh, apprehend their arrest in Itarhi P.S. Case No. 94/2016 registered under Sections 406, 420, 409/34 of the Indian Penal Code.
Present case is lodged against the petitioners for not submitting the folder files with regard to appointment of Panchayat Teachers. The petitioner no. 1 is the Panchayat Secretary Unwas, Badaka Gaon, Harpur-Jaipur Panchayats and the petitioner no. 2 is the Panchayat Secretary of Basudhar, Narayanpur, Jalwasi Panchayats. It is submitted that both the petitioners have been made In-charge of Panchayat Secretary of Harpur-Jaipur and Jalwasi Panchayats in the year 2016. The
Patna High Court Cr.Misc. No.39704 of 2016 (2) dt.17-09-2016 2/2 petitioners have already submitted the folders with regard to the appointment of Panchayat Teachers vide Annexure-3. Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. II, Buxar in Itarhi P.S. Case No. 94/16, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
