JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-11-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 294, 354B, 354(D) of the Indian Penal Code.

The accusation is of outraging the modesty of the niece of the informant by the petitioner and one Raj Kumar Sharma, whereas it is also alleged that petitioner took a snap of the niece of the informant.

It is submitted by learned counsel for the petitioner that even assuming the accusation, no offence under Section 354(B) and 354(D) is made out.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Barauli P.S. Case No. 166 of 2015, pending in the Court of

Patna High Court Cr.Misc. No.53223 of 2015 (2) dt.23-11-2015 2/2 learned Chief Judicial Magistrate, Gopalganj. With the observations above, the application stands disposed off.
