This application for regular bail arises out of Mokama P.S. Case No. 39 of 2019, disclosing offences punishable under Sections 25(1-B)a/26 of the Arms Act.

The petitioner is in custody since 21.02.2019. Allegedly from his possession, a country made pistol with five live cartridges were recovered by the police. Learned counsel for the petitioner has contended that the police have though submitted charge sheet, no sanction for prosecution under the Arms Act has so far been granted. Be that as it may, considering the nature of accusation and the petitioner's custody since February 2019, this application is allowed.
