The petitioner seeks regular bail in a case registered for the offences punishable under Sections 302, 120(B) and 34 of the Indian Penal Code.

After having surrendered, the petitioner is in custody since 01.09.2014. The petitioner was not named in the First Information Report. After nearly 38 days of the institution of the First Information Report, in courses of investigation, the petitioner's name has cropped up on the basis of the statement of some witnesses said to have seen this petitioner and Niraj Kumar Singh, a co-accused, disposing of the body of the deceased, the father of the informant.

No.50105 of 2014 (2) dt.03-03-2015 2 / 2 Mr. Abhay Kumar Singh, learned counsel appearing on behalf of the petitioner submits, with reference to Annxures to the bail application, that the petitioner had purchased some land from the informant through a registered sale-deed of which Neeraj Kumar Singh is a witness. Father of the informant had instituted a title suit being Title Suit No. 199 of 2012-13 for cancellation of the said registered sale-deed. He submits that it was in that background that the petitioner and the said Niraj Kumar Singh have been falsely implicated in the present case. He has further submitted that said Niraj Kumar Singh has been granted bail by this Court vide order dated 02.12.2014 passed in Cr. Misc. No. 46156 of 2014.

Considering the submission as above and considering the fact that similarly situated co-accused Niraj Kumar Singh has been granted bail, let the petitioner Santosh Kumar Singh, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Muffasil) P. S. Case No. 293/14.
