JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-02-2019 This is an application for grant of anticipatory bail in connection with Kishanganj P.S. Case No. 545 of 2018, disclosing offences under Sections 341, 323, 325, 307, 504, 506/34 of the Indian Penal Code.
Allegation against the petitioner no.1 is of assault by rod on the head of the informant and petitioner nos. 2 & 3 are also named in the F.I.R.
Submission of learned counsel for the petitioners is that the scuffle took place between two groups and though there is allegation of assault by rod, but now the compromise has been taken place between the parties, which will appear from Annexure-2. Further, they have no criminal antecedents.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Kishanganj, in connection with Kishanganj P.S. Case No. 545 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Amjad/- U T
