JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-02-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Motipur P.S. Case No. 279 of 2019 for the offenses under Sections 399, 402/34 of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arms Act.

Allegation against the petitioner is that on search from his possession one country made pistol with live cartridge was recovered.

Learned counsel for the petitioner submits that petitioner is in custody since 13.6.2019.

Considering the fact that the petitioner has remained in custody for more than seven months, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.

Patna High Court CR. MISC. No.8440 of 2020(2) dt.06-02-2020 2/2 50,000/-(Fifty Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, West Muzaffarpur in connection with Motipur P.S. Case No. 279 of 2019.
