JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-03-2020 Heard learned counsel for the petitioners; learned Additional Public Prosecutor appearing on behalf of the State and learned counsel appearing on behalf of the informant. The petitioners are apprehending arrest in connection with Neemachandpura P.S. Case No.45 of 2019 for offences under Sections 448, 341, 323, 307, 504 and 379/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedent.

The allegation against the petitioners is that on account of land dispute when the Panchayati was going on, the

Learned counsel for the petitioners submits that specific allegation of assault is not against the petitioners but against co-accused Rambadan Paswan.

Considering the fact that there is general and omnibus allegation of assault against the petitioners of using lathi, Danda, this Court is inclined to grant bail to them. Let petitioners, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Neemachandpura P.S. Case No. 45 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anil Kumar Upadhyay, J) BT/- U T
