From perusal of the writ application, it appears that the petitioner has a grievance against determination of the amount of compensation paid to him against acquisition of his land. According to the petitioner, his land, which has been acquired, is commercial/residential, whereas, the determination has been done, treating the land to be agricultural. In response to to a query made by this Court as to whether he has received the amount of compensation determined by the competent authority or not, learned counsel for the petitioner has submitted that the petitioner has received the amount of compensation after lodging his objection to the determination of the amount of
Patna High Court CWJC No.13182 of 2018(2) dt.19-04-2019 2/2 compensation.
If the petitioner has grievance against the manner of determination of the amount of compensation, the petitioner has remedy under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, which he can avail.
This writ application is accordingly disposed of with a liberty to the petitioner to make an application before the Collector for referring the matter to the competent authority for deciding his claim, which shall be considered in accordance with law.
