Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 366 of the Indian Penal Code.

It is alleged against the petitioners that they

Patna High Court CR. MISC. No.19465 of 2021(4) dt.14-02-2022 2/3 have abducted the wife of the informant and established physical relationship with her. The victim has not been recovered till date.

It is submitted by learned counsel for the petitioners that for the alleged occurrence of 05.01.2018, a complaint was filed on 23.01.2018 which came to be registered as F.I.R on 02.08.2018. The petitioners have falsely been implicated in this case and the thrust of accusation is against one Rajnath Ram. Considering the fact that there is direct allegation against the petitioners to have kidnapped the wife of the informant and the victim has still not been recovered, this Court is not inclined to grant privilege of anticipatory bail to the petitioners. The prayer for grant of anticipatory bail to the petitioners stands rejected. Let learned Court below consider the prayer for regular bail of the petitioners without being prejudiced by the order of this Court, if the petitioners surrender within a period of four week from today and pray for
