The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 120(B) and 34 of the Indian Penal Code read with Section 27 of the Arms Act.

Learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R. it would manifest that no specific allegation is attributed against the petitioner of causing firearm injury to the injured, it is next submitted that petitioner is a person with clean antecedent and the matter has been compromised as has been pleaded in paragraph '9' of the anticipatory bail application.

Patna High Court CR. MISC. No.9459 of 2022(2) dt.05-09-2022 2/2 At this stage, the learned counsel for the petitioner arguing vehemently seeks permission to withdraw the present anticipatory bail application Permission is accorded.

In the event, if the petitioner surrenders on or before 29.09.2022, the learned trial court shall dispose of the bail application on the same day keeping in mind the fact that petitioner is a person with clean antecedent, there is no specific allegation of firing against the accused and the parties have entered into a compromise realizing mistake.

Accordingly, the present anticipatory bail application is dismissed as withdrawn.
