JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-02-2020 The petitioner seeks regular bail in connection with Kheshar (Belhar) P.S. Case No. 280 of 2019, registered for offences punishable under Sections 30(a) (d) of the Bihar Prohibition and Excise Act, 2018 and Section 3 of Bihar Excise (Mahua Flower Rule) Act, 2016.

Allegation is of recovery of 55 kg of mahua flower and 7 litres of mahua wine.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in fact nothing has been recovered in this case. Further he has no criminal antecedent and has been in judicial custody since 17.01.2020 and ready to abide by any condition imposed on him. Heard learned A.P.P. also.

Having heard both sides, in view of the submissions

Patna High Court CR. MISC. No.7695 of 2020(2) dt.18-02-2020 2/2 as above, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additoinal Sessions Judge -II, Banka in connection with Kheshar (Belhar) P.S. Case No. 280 of 2019, subject to the condition that petitioner will cooperate in investigation and appear before the police as and when required, otherwise, the bail bonds of the petitioner will be cancelled.
