====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with G.O. Case No. 01 of 2020 for the offenses under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case total 108 ltrs of Nepali Saufi Wine was recovered. Nothing was recovered from the conscious possession of the petitioner. The petitioner is in custody since 02.01.2020.

Considering the fact that the petitioner has no criminal antecedent and nothing was recovered from the conscious possession of the petitioner, the Court is inclined to grant bail to

Patna High Court CR. MISC. No.7619 of 2020(2) dt.05-02-2020 2/2 the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge II cum Special Judge (Excise), Sitamarhi, in connection with G.O. Case No. 01 of 2020. However, in the event the petitioner is found involved in similar cases in future, the court below shall be at liberty to cancel the bail bonds of the petitioner in the present case.
