2. The petitioner is in custody in connection with Khagaria (Muffasil) P.S.Case No. 679 of 2023 for the offence punishable under Section 8(C), 20, 29 of N.D.P.S. Act.

3. It is alleged that petitioner has been named as involved in business of Narcotic substance and total 195.002 Kgs. of Ganja was seized.

4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. It is further submits that on the basis of confessional statement of son of Shanker Yadav, huge quantity of Ganja was recovered from the house of Shankar Yadav. Petitioner is in jail custody since 07.07.2023.

5. Learned APP has vehemently opposed the prayer

6. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III -cum-Special Judge, (NDPS), Khagaria, in connection with Special NDPS Case no. 23A of 2023 arising out of Khagaria( Muffasil) P.S. Case No. 679 of 2023.

7. As a condition of this order, the petitioner, after released on bail will mark his attendance at Maheshkhut Police Station on the first Sunday of each month. Any default in appearance at the police station would be result in cancellation of bail bond of the petitioner.

8. As a condition of this order, one of the bailors should be a close blood relative of the petitioner and the Court below will not insist for the local bailors.

9. Let a copy of this order be communicated to the Superintendent of Police, Khagaria District through FAX for its compliance.
