The petitioner seeks bail in connection with Amba P.S. Case No. 15 of 2015 registered for the offences punishable under Section 302 of the Indian Penal Code and under Section 3

(2) (V) SC/ST Act.

Allegedly, the petitioner took away Yogendra Choudhary, the son of informant for lifting sand on the tractor. Thereafter the informant was informed that villagers have caught the petitioner as he has killed Yogendra Choudhary. Submission is of false implication and that there is no eyewitness of the occurrence, only on suspicion the petitioner is suffering in custody since 23.02.2015 having no criminal

The learned A.P.P. opposes the prayer of bail by submitting that the deceased before his death has stated that the petitioner has assaulted him after providing drink. The learned A.P.P. referred para-13, 14 and 15 of the case diary. In the facts and circumstances stated above, considering the allegation against the petitioner serious in nature, this Court is not inclined to enlarge the petitioner on bail and accordingly his such prayer stands rejected in connection with Amba P.S. Case No. 15 of 2015 pending in the Court of learned 1st Additional Sessions Judge (Special Judge), Aurangabad in Sessions Trial No. 348/2015/72/2015.
