The present writ petition has been filed for seeking a direction upon the respondents to give the benefit of continuous service as well as seniority and also provide the benefit of the old pension scheme. Prayer has also been made to treat the petitioners as regular government employees in their

Patna High Court CWJC No.4749 of 2020(4) dt.27-06-2024 2/2 respective posts.

3. Learned counsel for the petitioners submits that the case of the petitioners is squarely covered with the judgement dated 03.04.2018 passed by this Court in CWJC No. 13797 of 2016.

4. Learned counsel for the State submits that the petitioners have not filed any representation till date before the authority concerned for redressal of their grievances.

5. As such, this writ petition is disposed off directing the petitioners to file their representation before the authority concerned i.e. respondent No.2, namely, the Chief Engineer, Rural Work Department, Vishwashriya Bhawan, Bihar, Patna within 30 days from today along with a copy of this order and respondent No.2 is directed to pass a reasoned and speaking order about the entitlement of the petitioner for relief within 90 days thereafter.

6. With the aforesaid observation and direction, the writ petition stands disposed off.
