====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-04-2025 Learned counsel for the petitioners seeks permission to withdraw this anticipatory bail application with regard to petitioner No. 2.
2. Permission is granted.
3. This anticipatory bail application with regard to petitioner No. 2 is, accordingly, dismissed as withdrawn.
4. Heard learned counsel for the petitioners and the State.
5. Petitioner No. 1 apprehends arrest in a case registered for the offences punishable under Sections 317(5), 318(4), 3(5) of the Bharatiya Nyaya Sanhita and Section 30(a), 32(1), 41(1) of the Bihar Prohibition and Excise Act.
6. As per prosecution case, total 4458.36 litres illicit
Patna High Court CR. MISC. No.9791 of 2025(3) dt.03-04-2025 2/2 liquor was recovered from a truck bearing registration No. UP 50 DT 6645.
7. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner. Petitioner is neither driver nor owner of the vehicle in question and he has been made accused in this case only on suspicion. Petitioner claims clean antecedent.
8. Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner No. 1 in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. II cum Additional District & Sessions Judge, Vaishali at Hajipur in connection with Mahua P. S. Case No. 1471 of 2024, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) Navya/- U T
