JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-02-2019 Heard learned counsel for the petitioner as well as learned counsel appearing on behalf of Vigilance Department. This application, for grant of anticipatory bail, arises out of Special Case No. 75A of 2014 (arising out of Karpi (Sahar Telpa) P.S. Case No. 122 of 2014), disclosing offences under Sections 420, 406, 409 and 34 of the Indian Penal Code. Petitioner happens to be Junior Engineer of the P.H.E.D. and the allegation against him is of embezzlement of Government money to the tune of Rs. 17,728, which was meant for construction of Toilet.

Learned counsel for the petitioner primarily denied the allegation levelled against him and submitted that he has falsely been made accused in this case. However, after some argument, he submitted that he is ready to deposit the amount in

Patna High Court Cr.Misc. No.8197 of 2019(2) dt.19-02-2019 2/2 question.

Having heard both sides, in view of above facts, let petitioner surrender in the court below along with a demand draft of Rs. 17,728/- drawn in favour of the Engineer in Chief, P.H.E.D. and the court below after verifying the same shall release the petitioner on bail to his own satisfaction on furnishing bail bonds of Rs. 25,000/- ( Rs. Twenty Five Thousand) with two sureties of the like amount, otherwise, the court below will be free to pass any order as he deems fit and proper.

With the above observation and direction, this application is disposed of.
