JUSTICE PURNENDU SINGH ORAL ORDER 22-02-2024 Heard Mr. Gajendra Singh, learned counsel appearing on behalf of the petitioner and Mr. Kumar Veerendra Narayan, learned APP appearing on behalf of the State.

2. The petitioner apprehends his arrest in connection with Muzaffarpur Town P.S. Case No. 849 of 2023 registered under Sections 147, 148, 149, 341, 323, 324, 153A, 120(B) and 290 of the Indian Penal Code.

3. As per the allegation made in the FIR, two groups entered into fierce fight as a result of international cricket match, in which Indian cricket team had won.

4. Learned counsel appearing on behalf of the petitioner submits that the communities of both sides were assembled, where the petitioner's side was celebrating the

Patna High Court CR. MISC. No.11847 of 2024(2) dt.22-02-2024 2/2 victory of Indian cricket team and they indulged into fierce fight. General and omnibus allegation has been levelled against the petitioner.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

6. Considering the rival submissions made on behalf of the parties, as well as, the fact that general and omnibus allegation has been levelled against the petitioner, I am of the opinion that petitioner has, prima facie, made out a case to be released on pre-arrest bail.

7. The learned Court below is directed to release the petitioner on anticipatory bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Town P.S. Case No.849 of 2023, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
