JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report with allegation that at the time of alleged occurrence he was carrying gun in his hand and in course of occurrence, he assaulted the injured, Vibha Devi with butt of gun causing injury on her head but submission on behalf of the petitioner is that injured, Vibha Devi sustained simple injury and so far as deceased is concerned, he is said to have been assaulted by co-accused, Haridwar Singh. It is also pointed out on behalf of the petitioner that there is case and counter case between the parties and persons from both the sides sustained injury and having more or less similar allegation, co-accused, Satyendra Singh and Ravindra

Patna High Court Cr.Misc. No.53346 of 2015 (2) dt.26-11-2015 2/2 Singh have already been granted privilege of bail by a co-ordinate Bench of this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Ara in connection with Udwantnagar P.S. Case No. 182 of 2015.
