JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-04-2019 This application, for grant of anticipatory bail, arises out of Sheikhopur Sarai P.S. Case No. 68 of 2016, disclosing offences under Sections 467, 468, 471, 419, 420, 120(B)/34 of the Indian Penal Code.
Allegation as per F.I.R is that police received information that some miscreants are engaged in the business of Chehra Pahchanao Inam Pao and cheating the people by collecting money from them, raided the place and arrested some accused persons and also recovered several articles, however, petitioner succeeded in fleeing away.
Submission of learned counsel for the petitioner is that save and except the disclosure made by the co-accused persons, there is absolutely nothing against the petitioner and

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additioanl Chief Judicial Magistrate, Sheikhpura, in connection with Sheikhopur Sarai P.S. Case No. 68 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
