The petitioner seeks bail in connection with Paroo P. S. Case No.308 of 2019, instituted for the offences under Section 394 of the Indian Penal Code.
The learned counsel for the petitioner submits that the petitioner is in custody since 28.09.2020 and charge-sheet has been submitted in this case.
The learned counsel for the petitioner further submits that informant, who works as D.S.C. Manager in Bandhan Bank, Maker, alleges that he along with his colleague after collecting Rs.80,000/- from their associates, distributed the money between themselves and were returning to Maker on their bike with Rs.40,000/- each and when they reached near Kamalpura
Patna High Court CR. MISC. No.19696 of 2021(3) dt.15-12-2021 2/3 Kothi, four miscreants on two motorcycles looted the amount from them and one of the miscreants also fired which hit the left thigh of the informant. Further the accused were in age group of 22-26 years.
The learned counsel for the petitioner submits that the F.I.R. was against unknown and this petitioner was remanded in this case from a different case where he was made to confess about his participation in the occurrence. Learned counsel further submits that the informant in the F.I.R. has given description of the accused, who committed the occurrence with regard to their age, but despite the petitioner being in custody since 28.09.2020, he has not been put on T. I. Parade. The learned counsel submits that the petitioner came to be implicated merely because of his criminal antecedents as mentioned in Para-3 of the petition.
Learned A.P.P. opposes the bail application.
Considering the fact that the petitioner is in custody since 28.09.2020, charge-sheet has been submitted in this case and he has not been put on T. I. Parade, the petitioner, abovenamed, is directed to be released on bail on his furnishing bailbonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.19696 of 2021(3) dt.15-12-2021 3/3 satisfaction of learned Additional Chief Judicial Magistrate-III, West Muzaffarpur in connection with Paroo P. S. Case No.308 of 2019, with a condition that the petitioner in between 20th25th of every month commencing from January, 2022 will keep marking his attendance in the concerned police station till framing of charge, the concerned police station will report to the learned Court below on 28th of every month from January, 2022 that the petitioner is marking his attendance in the police station. In the event, it is reported that the petitioner in between the aforesaid dates in any of the month has not marked his attendance before framing of charge, the learned Court below will proceed to cancel his bail bonds.
The application stands allowed.
