JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 27-06-2018 Learned counsel for the petitioner submits that, while passing the order dated 03.05.2018 in Cr.W.J.C. No.836 of 2018, this Court had imposed certain conditions to be complied with by the petitioner for the purpose of release of the vehicle in question. It is submitted that one of the conditions being original title deed of immovable property lying within the jurisdiction of the court is also contained therein. However, the petitioner does not have any immovable property in his own name within the jurisdiction of the Court. It is submitted that the mother of the petitioner is ready and willing to submit the original title deed of the immovable property standing in her name as security for the purpose of release of the vehicle in question.
Patna High Court Cr.Misc. No.36308 of 2018 (2) dt.27-06-2018 Learned counsel for the State is present.
In the nature of the submissions made, let the original title deed of the immovable property free from all encumbrances standing in the name of the mother of the petitioner, if offered as security and is found genuine, be accepted by the Collector-cumDistrict Magistrate, Katihar, for the purpose of release of the vehicle with such conditions as he may impose for the purpose of securing the release.
The application stands disposed off.
