The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 354B, 379 and other sections of the Indian Penal Code. As per the prosecution case the petitioner, his son and wife came and assaulted the informant and his wife with the intention to kill. It is stated that on their mother and father coming, they also beat up the informant.
It is submitted by learned counsel for the petitioner that the allegations as levelled in the FIR are false and concocted. The petitioner who happens to be the full brother of the informant has been falsely implicated in the case. There is case and counter case between the parties and the FIR of the
Patna High Court CR. MISC. No.20522 of 2021(2) dt.21-09-2021 2/2 counter case having been brought on record as Annexure-2 to the petition. Almost all the injuries except one have been found to be simple in nature. The petitioner is in custody since 29.11.2020 and charge sheet has been submitted in the case. Heard learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the relationship between the parties, there being case and counter case between them and the petitioner having remained in custody for over 9 months, the Court directs the petitioner to be enlarged on bail in connection with Laukaha (Lalmaniya) P.S Case no. 124 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Jhanjharpur, District Madhubani.
