One country made loaded pistol was recovered beneath bed of the petitioner and nine live cartridges were recovered from his conscious possession for which petitioner is languishing in jail custody since 16.9.2014.

No doubt, petitioner carries criminal antecedent but it appears that two cases were registered against the petitioner in the year 1998 and third case was registered in the year 2014 and there is nothing on record to show that between 1998 to 2014 any other case was registered against him.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate,
