JUSTICE SATYAVRAT VERMA ORAL ORDER 15-11-2021 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in connection with Dehri (Town) P. S. Case No.813 of 2019 registered for the offences punishable under Sections 302, 387, 120(B), 34 of the I.P.C. and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R., it would manifest that the informant has alleged that she received an information on her mobile phone that her husband received the bullet injury and he is under the treatment of Dr. Birendra and when she reached at the hospital where the husband disclosed that when he was returning from Nisad saw mill and reached

No.19648 of 2021(2) dt.15-11-2021 2/3 near the Tar Bangala Pul, the accused Ranjay Kumar @ Abhishek Kumar on his motorcycle along with some unknown persons was driving the same, stopped him and caused bullet injury to him. The husband of the informant for better treatment had referred to Varanasi, but he died on the way. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name has come on the confessional statement of co-accused Ranjay Kumar @ Abhishek Kumar. The said Ranjay Kumar @ Abhishek Kumar has been granted regular bail by a co-ordinate Bench of this Court vide order dated 21.05.2021 passed in Cr. Misc. No.2052 of 2021 and the charge-sheet has been submitted.

Apart from this case, the petitioner is accused in one more case as mentioned in Para-3 of the bail petition. Learned A.P.P. vehemently opposes the prayer. Considering the fact that the co-accused Ranjay Kumar @ Abhishek Kumar has been granted regular bail by a Bench of this Court. The petitioner is in custody since 03.05.2020 and charge-sheet has already been submitted, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M.
