1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and Sudish Kumar (petitioner no. 1) is alleged to have assaulted the son of the informant, namely, Rangila Kumar by farsa causing injury on head. Further, Sagar Kumar (petitioner no. 2) is alleged to have assaulted Rangila Kumar by an iron rod causing injury on hand and Sunil Sahani (petitioner no. 3) is alleged to have snatched
Patna High Court CR. MISC. No.8024 of 2025(2) dt.06-03-2025 2/3 silver chain of his son and also assaulted Rakesh Sah another son of the informant by bricks.

Learned counsel for the petitioners submits that from perusal of para 6 of the order impugned, it would manifest that as far as Rangila Kumar is concerned, it has been recorded that Rangila Kumar sustained pain on head, nose and backside but there was no visual mark of injury in NCCT of head calcified granuloma found in occipital region. It is further submitted that with respect to Rakesh Sah, it has been recorded that he sustained fracture of proximal phalanx of little finger which is opined to be grievous in addition to abrasion on left shoulder. Learned counsel submits that though it is alleged that on account of previous dispute, the occurrence took place but then the nature of dispute which was existing in between the son of the informant and the petitioners is not disclosed.
It is next submitted that from perusal of the allegation, it would manifest that an attempt has been made to implicate the entire family members including the female members. It is also submitted that even presuming what has been alleged is true without admitting then the injury suffered by Rakesh is on non-vital part of the body.
5. Learned A.P.P. for the State opposes the prayer for
Patna High Court CR. MISC. No.8024 of 2025(2) dt.06-03-2025 3/3 anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Sangrampur P.S. Case No. 96 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Kundan/- U T
