In this case, the petitioner is seeking regular bail in connection with Adapur P.S. Case No.103 of 2015, registered for the offence punishable under Section 392 of the Indian Penal Code.
Allegation has been made that when the victim was returning from the Nepal by his motor cycle some miscreants have intercepted and snatched away a sum of Rs.3, 500/- including the mobile phone. During the investigation, it was found that the petitioner was using the said mobile.
Learned counsel for the petitioner submits that the sim that was used in the said mobile is standing in the name of the father of
Patna High Court Cr.Misc. No.52160 of 2015 (3) dt.09-02-2016 2/2 the petitioner.
Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, liberty is granted to the petitioner to renew his prayer for bail after completing one year of his custody.
