JUSTICE PRABHAT KUMAR JHA ORAL ORDER 28-01-2015 Heard Mr. N.K. Agrawal, learned Senior Advocate for the petitioner, and learned A.P.P. for the State. The petitioner seeks regular bail in a case registered under Sections 8 and 20 the N.D.P.S. Act.
Prayer for bail of the petitioner was earlier rejected by this Court vide order dated 10.09.2014 passed in Cr. Misc. No. 31230 of 2014.
It appears that 19 kg of Ganja was recovered from the possession of the petitioner and the petitioner is in jail since 15.04.2014.
The trial court has reported that the trial has already begun but not a single witness has been examined as yet. Considering the fact that the petitioner has remained
Patna High Court Cr.Misc. No.39 of 2015 (3) dt.28-01-2015 2/2 in jail for less than a year, I am not inclined to enlarge the petitioner on bail in Narcotics Control Bureau F. No. NCB/PZU/V/03/2014, pending in the court of the learned A.D.J. VII, Patna. Accordingly, the same is rejected. The petitioner, if so advised, may renew his prayer for bail after remaining in jail for a year.
