The petitioners seek pre-arrest bail in connection with Dehri (T) P.S. Case No. 251/15 registered under Sections 147, 148, 149, 341, 323, 353, 337, 338, 307, 420, 120-B of the Indian Penal Code, 27 of the Arms Act, Sections 33/41/42 of the Indian Forest Act, 1927 and Sections 4(1), 1 and 4A (1) of the Mines and Minerals (Development and Regulation) Act, 1957. It is contended that co-accused Kalam Hussain,
Patna High Court Cr.Misc. No.53609 of 2015 (2) dt.07-12-2015 2 / 2 whose case is identically situated to that of the petitioners, has already been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 16th October, 2015. A web copy of the order has been produced by the learned counsel for the petitioners before the Court. Let the same be kept on record. Regard being had to the reasons assigned in the aforesaid order dated 16th October, 2015, in the event of arrest or surrender in the court below within four weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Dehri, Rohtas in connection with Dehri (T) P.S. Case No. 251/2015 subject to the conditions as laid down under Section 438(2) Cr. P.C.
