JUSTICE PARTHA SARTHY ORAL ORDER 9-09-2020 Heard learned counsel for the petitioner and learned counsel for the State through video conferencing. The petitioner has filed the instant application for grant of anticipatory bail apprehending his arrest in connection with Punpun P.S. Case no. 185 of 2019 (Special Case no. 6467 of 2019) registered under sections 307, 147, 148, 149, 341, 323, 337, 338, 427, 353, 379, 504 and 506 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016. As per allegation in the FIR, on receiving secret information about manufacturing of illicit liquor, it is stated by the informant that a raid was conducted. 30 litres of Mahua liquor was recovered and accused Bigan Manjhi was taken into custody. It is further stated that on the instigation of this petitioner the 16 other named accused persons as also 20-25

2/3 unknown persons variously armed attacked the police party, injured the Chowkidar and the police personnel. It is submitted by learned counsel for the petitioner that the allegation as levelled in the FIR are totally false, fabricated and manufactured only with the purpose to extort money. The allegations are general and omnibus in nature. Contrary to the allegation no person has sustained any injury. The petitioner has no criminal antecedent and co-accused Sanjay Manjhi and Kailash Manjhi have been enlarged on bail vide order dated 23.9.2019, Annexure-2 to this petition. The application for bail is opposed by learned counsel for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the grant of bail to the co-accused as also the petitioner not having any criminal antecedent, the Court is inclined to enlarge the petitioner on anticipatory bail. The petitioner is directed to surrender in the Court below within a period of eight weeks from today and in the event of his arrest or surrender in connection with Punpun P.S. Case no. 185 of 2019 (Special Case no. 6467 of 2019) he will be enlarged on bail on furnishing bail bond of Rs. 10,000/ (Ten Thousand) with two sureties of the

3/3 like amount each to the satisfaction of learned Special Judge, Excise, Patna subject to the conditions as laid down under section 438(2) of the Cr.P.C.
