Petitioners are accused in connection with Sanhaula P.S. Case No. 58 of 2015 registered under Sections 302/34 of the I.P.C. and 27 of the Arms Act.
The prosecution case is that Panchu Choudhary, son of the informant had gone Sanhaula Hat in the evening of 28.07.2015 to bring the diesel, but he did not return. On the next day, in the morning, rumor spread in the village about lying the dead body of his son in the field sustaining fire arm injury at his temporal region, at that time, cousin nephew, Arbind Choudhary, Pankaj Choudhary, Sargun Choudhar and petitioners had left their house with family. The informant raised suspicion regarding the
Patna High Court Cr.Misc. No.51409 of 2015 (2) dt.21-12-2015 2/2 death of his son Panchu Choudhary against the petitioners and three other co-accused persons due to land dispute. Learned counsel appearing on behalf of the petitioners submits that petitioners are gotia of the informant and due to land dispute, they have falsely been implicated in this case mere on suspicion. It is submitted that petitioners have no criminal antecedent and are in custody since 02.08.2015. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of J.M., 1st Class, Bhagalpur in connection with Sanhaula P.S. Case No. 58 of 2015, G.R. No. 2735 of 2015.
