JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased whose dead body was found in a field and just after recovery of dead body when house of the petitioner was raided, he along with his children was found absent by the police. Moreover, in course of investigation, it came to light that deceased used to talk with some unknown persons on mobile for which quarrel used to be taken place between deceased and petitioner and except the aforesaid material, there appears to be nothing against the petitioner who is languishing in jail custody since 15.09.2014. The investigation against the petitioner has already been completed and now, it is not desirable to keep the petitioner behind the bar

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Salkhua P.S. Case No. 124 of 2013.
