Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier the prayer for bail of the petitioner was rejected by this court vide order dated 09.02.2015 passed in Cr. Misc. No. 5253 of 2015 directing the trial court to conclude the trial of the petitioner within six months from the date of receipt/production of copy of the aforesaid order and a liberty was given to the petitioner to renew his prayer for bail before the trial court itself, if the trial of the petitioner is not concluded within the above stated period.

Learned counsel for the petitioner drew my attention

Patna High Court Cr.Misc. No.51776 of 2015 (2) dt.27-01-2016 2/2 towards Annexure-3 to the supplementary affidavit and submits that the order dated 09.02.2015 passed in Cr. Misc. No. 5253 of 2015 was received in the trial court on 13.02.2015 but up till now, only one prosecution witness could be examined and the petitioner is in jail custody since 12.08.2014.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 448 of 2014.
