The petitioners apprehend their arrest in connection with Bahadurpur P.S. Case No.424 of 2018 registered under Sections 363 and 366(A)/34 of the Indian Penal Code.
The accusation is of enticing away the daughter of the informant/opposite party no.2 by the petitioners and their son Shambhu Kumar. Shambhu Kumar used to chase and tease the daughter of the informant/opposite party no.2. Learned counsel appearing on behalf of the petitioners submits that, in fact, the daughter of the informant/opposite party no.2 left her parental house at her own sweet will and performed the marriage with Shambhu Kumar, the son of the petitioners, and both
Patna High Court CR. MISC. No.8692 of 2019(5) dt.07-05-2019 2/2 are leading conjugal life happily. Due to misunderstanding, the informant/opposite party no.2 lodged the present case but after realizing his mistake, he filed the compromise petition in the court of the Chief Judicial Magistrate, Darbhanga, to compromise the case, on 24.11.2018.
On the other hand, learned counsel appearing for the informant/opposite party no.2 has submitted that the daughter of the informant/opposite party no.2 has performed her marriage with Shambhu Kumar, the son of the petitioners, and both are leading conjugal life happily and, now, the informant/opposite party no.2 has no objection in allowing the prayer of the petitioners for grant of prearrest bail. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Darbhanga, in connection with Bahadurpur P.S. Case No.424 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
