JUSTICE ARVIND SRIVASTAVA ORAL ORDER 10-01-2022 At the outset, learned counsel for the petitioners seeks permission to withdraw the application as against petitioner 1 as he has been arrested during pendency of this application.

Permission is granted.

The application, thus, stands dismissed as withdrawn as against petitioner no. 1.

Heard learned counsels for the petitioners, the informant and the State.

Petitioners apprehend arrest in connection

Patna High Court CR. MISC. No.19792 of 2021(2) dt.10-01-2022 2/2 with Jurawanpur P.S. Case No. 46 of 2020 registered for the offence punishable under sections 304(B)/120(B)/34 of the Indian Penal Code.

Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case merely because they are the relatives of the husband of the sister of the informant. Nothing specific is alleged against them. The husband of the deceased is in custody, as stated in paragraph 11 of the petition. Petitioners have no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners no. 2 and 3, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Jurawanpur P.S. Case No. 46 of 2020 subject to the conditions laid down under section 438(2) Cr.P.C. (Arvind Srivastava, J) mcv/- U T
