====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 15-12-2016 Heard the learned counsel, Mr. Shashi Nath Jha, for the petitioner. This application has been filed under Article 227 of the Constitution of India for a direction to the Sub Judge Ist, Bhagalpur to dispose of Money Execution Case No.2 of 2009 expeditiously.
In my opinion, for the relief claimed by the petitioner in the judicial side, this application is not maintainable.
It is settled law that the High Court exercises supervisory jurisdiction in administrative side and in judicial side. So far judicial side is concerned under Article 227, the High Court exercises supervisory jurisdiction for examining the orders passed by the Court below after the amendment of the Code of Civil Procedure by amendment Act No.22 of 2005. Thus, this Civil Misc. application is dismissed. The petitioner may pursue his remedy before the Court concerned. (Mungeshwar Sahoo, J) Sanjeev/- U T
