JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-07-2020 Heard Mr. Anil Kumar Singh, learned counsel for the petitioner and Ms. Rina Sinha, learned APP for the State. The petitioner was granted provisional anticipatory bail vide order dated 03.07.2019. However, the petitioner could not surrender before the court below and therefore he could not furnish his bail bonds. However, vide order dated 26.09.2019, the provisional bail of the petitioner was confirmed without the petitioner having furnished his bail bonds.
Today, the petitioner wants modification of the
Patna High Court CR. MISC. No.11917 of 2020(2) dt.02-07-2020 2/2 order dated 03.07.2019 for extending the time for furnishing his bonds.
This Court is at a loss to understand as to how the order dated 03.07.2019 would stand in isolation. The order referred to above has already merged with order dated 26.09.2019.
However, considering the fact that the petitioner has not furnished his bail bonds, this Court only directs by way of modification of the orders referred to above that in case the petitioner surrenders before the court below and furnishes his bail bonds within a period of six weeks, the same shall be allowed.
The modification application stands allowed to the extent indicated above.
