Petitioner is accused in connection with Bhagwanpur P.S. Case No. 141 of 2018 registered under Sections 302 and 120(B)/34 of the I.P.C.

Submission of learned counsel for the petitioner is that the informant has lodged this case only on the basis of information of the villagers. There is no eye witness to the alleged occurrence. The statement of Neeraj Sah has not been recorded in course of investigation, while the occurrence took place in front of his shop.
