JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2020 Petitioner seeks regular bail in connection with Bajpatti P.S. Case No. 310 of 2019 registered for the offence punishable under Sections 399, 402, 414 and 413 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act. Allegation as per F.I.R. is of on secret information that five miscreants upon two motorcycles are proceeding from Sitamarhi to commit some serious occurrence, upon which, the informant alongwith police party started checking of vehicle and arrested some persons and they have disclosed the name of petitioner who have succeeded to flee and it further appears that the petitioner had criminal antecedent, and accused in case of almost of similar nature.

Submission of the learned counsel for the petitioner is that so far this case is concerned, nothing has been recovered

Patna High Court CR. MISC. No.7395 of 2020(2) dt.25-02-2020 2/2 from the conscious possession of the petitioner and the name of the petitioner has been disclosed on confessional statement of co-accused and petitioner is in custody since 18.12.2019. Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri, Sitamarhi in connection with Bajpatti P.S. Case No. 310 of 2019.
