The petitioner is in custody in connection with Revilganj P.S. Case No. 368 of 2019, for the offence under Sections 188 and 272/34 of the Indian Penal Code; Sections 30, 38, 41 of the Bihar Prohibition and Excise Act, 2016; and Sections 180, 182 and 184 of the Motor Vehicle Act. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 07.01.2020. He further submits that in the instant case total 82.92 litres of foreign liquor was seized. No test identification parade was conducted.

Considering the fact that the petitioner has got no criminal antecedent and nothing was recovered from his

Patna High Court CR. MISC. No.8461 of 2020(2) dt.06-02-2020 2/2 conscious possession, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise , Saran at Chapra in connection with Revilganj P.S. Case No. 368 of 2019.
