Petitioner is accused in connection with S. Tr. No. 83 of 2015 arising out of Sasaram (Town) P.S. Case No. 934 of 2014 registered under Sections 364, 365 and 302 of the I.P.C. The prosecution case is that the marriage of Pramod Thakur, brother of the informant, Lalan Thakur, was performed with Guria Devi before 9 years. Guria Devi had illicit relation with one Mantu Sharma. Pramod Thakur, brother of the informant, who used to work in saloon, used to protest the illicit relation of Mantu Sharma and Guria Devi, his wife. On 02.10.2014, Ratan Kumar Sharma, Munna Kumar Sharma, Ratan Kumar Sharma accompanied to Pramod Thakur, brother of the informant for entertaining in Durga Puja, but Pramod Kumar Sharma, brother of

Patna High Court Cr.Misc. No.51719 of 2015 (3) dt.22-12-2015 2/2 the informant, did not return. Later on, deceased Pramod Kumar was found in District Aurangabad.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that petitioner has falsely been implicated in this case showing his involvement in the murder of brother of the informant only on the basis of illicit relation with the wife of the deceased. It also appears from perusal of the case diary that except suspicion raised by the informant, there is nothing against the petitioner to show his involvement in the present case. It is further submitted that petitioner has no criminal antecedent and is in custody since 08.10.2014.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 7th Addl. District and Sessions Judge, Sasaram, Rohtas in connection with Sessions Trial No. 83 of 2015 arising out of Sasaram (Town) P.S. Case No. 934 of 2014.
